INTRODUCTION

We at Phantom Hive work on improving all ways possible to achieve excellent services for both drivers and riders, this includes collect, use, and share your information. This process help developing our system, reduce the fare on riders, reduce or eliminate fees applied by other rideshare companies using the AI technology, increase the drivers’ wages based on per trip.​ We here refer to Phantom Hive, Phantom Electronics as Phantom

SCOPE

Our policy is made for and apply to all Phantom hive users, riders and drivers, for all online and non-online services provided or offered by Phantom Hive and Opulence Corporation of America, Opulence, Inc. Phantom HIVE is a branch of Opulence Corporation of America, for more details visit our website Opulence.us.

The user information are information needed to successfully accomplish the user’s request of a ride, lease a vehicle, or rent through our platform. We may share some information with our third-party companies or agencies. We work on having your information classified. All Phantom Hive and Opulence, Inc are subject to our Terms of Service and Use

COLLECTED INFORMATION

When you use Phantom Hive and Opulence Corporation Platform, we collect the information you provide, usage information, and information about your device. We also collect information about you from other sources like service providers, and optional programs in which you participate, which we may combine with other information we have about you. Here are the types of information we collect about you:

Information You Provide to Us
  • Account information: We collect data when users create or update their Hive accounts, or place orders via guest checkout features. This includes first and last name, email, phone number, login name and password, address, profile picture, payment or banking information (including related payment verification information), user settings (including accessibility settings), and loyalty program information for Phantom Hive, Phantom, and Opulence Corporation partners.

    For drivers and delivery persons, this also includes vehicle or insurance information, emergency contact information, and evidence of health or fitness to provide services using HIVE apps. 
  • Background check information (drivers and delivery persons): This includes information submitted during the driver/delivery person application process, such as driver history or criminal record (where permitted by law), license status, known aliases, prior addresses, and right to work. This information may be collected by Phantom service providers.
  • Identity verification documents and photos: This includes government issued identification such as driver’s license or passports (which may contain identification photos and numbers, date of birth, and gender), and user-submitted photos such as selfies and profile pictures.
  • Demographic data: We collect demographic data such as birth date/age, gender or occupation when necessary to enable certain features, or provide access to age-restricted products or services. For example, when there is a purchase of alcohol or cannabis products or request any drink contains Alcohol as a side service to provide or extras. We also collect or infer (using first name) gender information to enable female or non-binary users to designate their preference for providing or receiving services to/from female or non-binary users, as well as for marketing and advertising.
Information We Collect When You Use the Phantom Platform

Location Information. Great rides start with an easy and accurate pickup. The Phantom Platform collects location information (including GPS and WiFi data, IP address, and Bluetooth data) differently depending on your HIVE app settings and device permissions as well as whether you are using the platform as a Rider or Driver:

  • Riders: We collect your device’s precise location when you open and use the HIVE app or services, including while the app is running in the background from the time you request a ride until it ends.
  • Drivers: We collect your device’s precise location when you open and use the app, including while the app is running in the background. We also collect precise location for a limited time after you exit driver mode in order to detect ride incidents, and continue collecting it until a reported or detected incident is no longer active. If you choose to install a Phantom Platform device in or on your vehicle (e.g., a Phantom dashboard device or tablet), that device may collect precise location information when turned on.

Usage Information. We collect information about your use of the Phantom Platform, including ride information like the date, time, destination, distance, route, payment, and whether you used a promotional or referral code. Information about your interactions with the Phantom Platform like our apps and websites, including the pages and content you view and the dates and times of your use.

Device Information. We may collect information about the devices you use to access the Phantom Platform, including device model, IP address, type of browser, version of operating system, identity of carrier and manufacturer, radio type (such as 4G), preferences and settings (such as preferred language), application installations, device identifiers, advertising identifiers, and push notification tokens. If you are a Driver, we also collect mobile sensor data from your device (such as speed, direction, height, acceleration, deceleration, and other technical data). If you have installed a Lyft Platform device in your vehicle (e.g., a Phantom dashboard device or tablet), that device may similarly collect sensor data and other information like location, as described when you choose and set up such devices.

Communications Between Riders and Drivers. We work with a third party to facilitate phone calls and text messages between Riders and Drivers without sharing either party’s actual phone number with the other. But while we use a third party to provide the communication service, we collect information about these communications and Phantom Platform chat communications, including the participants’ phone numbers, the date and time, and the contents of SMS and chat messages. For security purposes, we may also monitor or record the contents of phone calls made through the Phantom Platform, but we will always let you know we are about to do so before the call begins.

 

Cookies, Analytics, and Third-Party Technologies. We collect information through the use of “cookies”, tracking pixels, data analytics tools like Google Analytics, SDKs, and other third-party technologies to understand how you navigate through the Phantom Platform and interact with advertisements, to make your Phantom experience safer, to learn what content is popular, to improve your site experience, to serve you better ads on other sites, and to save your preferences. Cookies are small text files that web servers place on your device; they are designed to store basic information and to help websites and apps recognize your browser. We may use both session cookies and persistent cookies. A session cookie disappears after you close your browser. A persistent cookie remains after you close your browser and may be accessed every time you use the Phantom Platform.

Inferences. We may infer certain information from your interactions with the Phantom Platform and other personal information available to us. For example, if you frequently ride to or from airports, we may infer you are a frequent traveler. We may also draw inferences from the information you provide to us, such as inferring your gender based on your first name.

Information We Collect From Other Sources

Service Providers and Other Parties. Service providers and other parties provide us with information needed for core aspects of the Phantom Platform, as well as for additional services, programs, loyalty benefits, and promotions that can enhance your Phantom experience. These service providers and other parties include background check providers, insurance partners, financial service providers, marketing providers, and other businesses. We obtain the following information about you from these parties:

  • Information to make the Phantom Platform safer, like background check information or identity verification information;
  • Information about your participation in third-party programs that provide things like insurance coverage and financial instruments, such as insurance, payment, transaction, and fraud detection information;
  • Information to operationalize loyalty and promotional/marketing programs or applications, services, or features you choose to connect or link to your Phantom account, such as information about your use of such programs, applications, services, or features; and
  • Information about you provided by specific services, such as vehicle, demographic, and other information that helps us provide services or to personalize our marketing.

Enterprise and Delivery Programs. If you use Phantom through your employer or other organization that participates in one of our Phantom Business enterprise programs, we will collect information about you the user and/or applicant from those parties, such as your name and contact information. If an organization has utilized Phantom to fulfill a delivery to you, we may receive information like your name and delivery address from the organization in order to fulfill the delivery.

Concierge Service. Sometimes another business or entity may order you a Phantom ride. If an organization has ordered a ride for you using our Concierge service, they will provide us your contact information and the pickup and drop-off location of your ride.

Other Users and Sources. Other users or public or third-party sources such as law enforcement, insurers, media, or pedestrians may provide us information about you, for example as part of an investigation into an incident or to provide you support.

HOW TO USE

Phantom uses data to enable reliable and convenient transportation, delivery, and other products and services. We also use data:

  • to enhance the safety and security of our users and services
  • for customer support 
  • for research and development 
  • to enable communications between users 
  • for marketing and advertising
  • to send non-marketing communications to users
  • in connection with legal proceedings

 

Phantom uses the data we collect:

  1. To provide our services. Phantom uses data to provide, personalize, maintain, and improve our services.

    This includes using data to:
  • create/update accounts.
  • enable transportation, delivery and other services/features, such as:
    • using location data to navigate rider pick-ups and order drop-offs, calculate ETAs, and track the progress of rides or deliveries.
    • enabling features that involve data sharing, such as sharing driver first name and vehicle information with riders to facilitate pick-ups, or features that enable ETA sharing and fare splitting.
    • matching available drivers and delivery persons to users requesting services, including based on personal data such as location and proximity to other users, and user settings / preferences (such as preferred destinations), and non-personal data such as vehicle type requested.

      In connection with programs PHANTOM RESERVE, matches are also determined using cancellation rates, ratings and user behavior information.

    • enabling accessibility features.
    • facilitating and optimizing rental cars’ reservation, pick up and drop off through Phantom Rent.
  • Calculating Prices and fares, including using location data and trip or order details (such as requested pick-up and drop off addresses). We may also consider non-personal data or factors, including date and time, estimated distance and time, minimum base fares, tolls, taxes and fees.
  • process payments, and enable payment.
  • facilitate insurance, vehicle, invoicing, or financing solutions.
    • provide users with trip or delivery updates, generate receipts, and inform them of changes to our terms, services, or policies.
    • perform necessary operations to maintain our services, including to troubleshoot software bugs and operational problems.

    Phantom performs the above activities on the grounds that they are necessary to fulfill the terms of our agreements with users, are compatible with such uses, or are necessary for purposes of Phantom’s and its users’ legitimate interests.

    1. Safety, fraud protection and security. We use data to help maintain the safety, security, and integrity of our services and users. This includes:
    • verifying users’ accounts, identity or compliance with safety requirements.

      For example, we review driver and delivery person background checks (including criminal history where required or permitted by law) to verify their identities and eligibility to provide transportation or deliveries.

      In the United States, we may also perform rider and order recipient identity verification using names, date of birth, emails, telephone numbers, payment information, and third party wallets, to help deter use of our services by fraudulent accounts.

      We also require verification of user identity and/or age to use payment methods such as cash, receive deliveries of alcohol or cannabis, or use products offered by Phantom. We process and compare user profile pictures, government-issued identification photos and numbers, or other user-submitted photographs to perform this verification, including in some regions through use of facial recognition technology. We also use such technology to prevent fraudulent use of identification photos, or to prevent users from creating multiple accounts.
    • using customer service information (including reports of safety incidents), device data (e.g., to detect speeding or harsh braking / acceleration), transaction, and usage data to identify potentially unsafe drivers and driving. This can lead to drivers and delivery persons receiving messages encouraging safer driving, and/or account deactivation following human review. 
    • using account, device, location, usage, transaction, wireless carrier, and other data, including communications between users and metadata, to prevent, detect, and combat fraud, including by guest users. 
    • using reported incidents, user ratings*, and other feedback to encourage safe use of Phantom’s platform and compliance with our terms and as grounds for deactivating users with low ratings.
    • using driver data (such as past trip information and reported incident rates) and rider data (such as account information, cancellation and reported incident rates, current pick-up and drop-off location, past trip information, and ratings information) to predict and help avoid pairings of users that may result in increased risk of conflict.* We also avoid pairings where one user has previously given the other a low (e.g., 1 star) rating.
    • using location, phone number, user name, vehicle details and other relevant information from safety experts during trips or deliveries.

The fraud and unsafe driving prevention and detection activities described above may be considered profiling under applicable laws, and can result in deactivation of users (generally only after human review). For information regarding how to object to the above activities, please see “Choice and transparency” below.

Phantom performs the above activities on the grounds that they are necessary to fulfill the terms of our agreements with users, and/or for purposes of the legitimate safety and security interests of Phantom, our users and members of the general public.

  1. Customer support. We use the information we collect (which may include call recordings, chat logs, in-app audio recordings and dashcam footage) to provide customer support, including to investigate and address user concerns and to monitor and improve our customer support responses and processes.

    Phantom performs the above activities on the grounds that they are necessary to fulfill the terms of our agreements with users or for purposes of Phantom’s legitimate interests in monitoring and improving its customer support services.
  2. Research and development. We use data for analysis, machine learning, product development, research, and testing. This helps us make our services more convenient and easy-to-use, enhance the safety and security of our services, and develop new services and features.

    Phantom performs the above activities on the grounds that they are necessary for purposes of Phantom’s legitimate interests in improving and developing new services and features.
  3. Enabling communications between users. For example, a driver may message or call a rider to confirm a pick-up location, a rider may call a driver to retrieve a lost item, or a restaurant or delivery person may contact an order recipient with information about their order.

    Phantom performs the above activities on the grounds that they are necessary to fulfill the terms of our agreements with users.
  4. Marketing and Advertising. Phantom uses data (other than guest users’ data) to market its services, and those of Phantom partners.

We specifically use account, approximate location, device and usage data, preferred language, and trip and order history to provide ads and marketing communications that are personalized based on users’ observed or inferred location, interests and characteristics (which may include inferred gender*).

This includes using this data to:

  • send emails, text messages, push notifications, and in-app messages or other communications marketing or advertising Phantom products, services, features, offers, promotions, sweepstakes, news and events. For example, we may send push notifications suggesting a user’s favorite destinations or merchants, or in-app messages offering discounts or promo for products or merchants similar to those a user has previously ordered.
  • display personalized advertising on third party apps or websites. 
  • display third party advertising in Phantom’s apps or in connection with our services. For example, we display ads for restaurants or merchants that are available on Phantom’s apps. These ads (which are identified as “Sponsored Listings” in Phantom’s apps) include recommendations that are personalized based on users’ location and order histories.

We also display ads for third party products that are not available on Phantom’s apps. These ads may contain links to third party apps or websites. Users should refer to such third parties’ privacy notices for information on their collection and use of data when visiting such apps or websites.

We also provide ads that are personalized based on data about users’ current trip or delivery request, including time of request and services requested. For example, if a user requests a trip to a supermarket, we may display in-app ads for third party products that may be available at that supermarket.

We also measure the effectiveness of Phantom’s ads, and of third party ads displayed in Phantom’s apps or in connection with our services.

Phantom performs the above activities on the grounds that they are necessary for purposes of Phantom’s legitimate interests in informing users about Phantom services and features or those offered by Phantom partners. See the sections titled “Choice and transparency” and “Marketing and advertising choices” for information on users’ choices regarding how Phantom may use their data for marketing and advertising.

  1. Non-marketing communications. Phantom may use data to send surveys and other communications that are not for the purpose of marketing the services or products of Phantom or its partners. We may also send users communications regarding elections, ballots, referenda, and other political processes that relate to our services. For example, Phantom has notified users of ballot measures or pending legislation relating to Phantom’s services in those users’ areas.

    Phantom performs the above activities on the grounds that they are necessary to fulfill the terms of our agreements with users, or for purposes of Phantom’s and its users’ legitimate interests in informing users about events that may have an impact on their use of Phantom’s services.

8. Legal proceedings and requirements. We use data to investigate or address claims or disputes relating to use of Phantom’s services, to satisfy requirements under applicable laws, regulations, operating licenses or agreements, insurance policies, or pursuant to legal process or governmental request, including from law enforcement.
Phantom performs the above activities on the grounds that they are necessary for purposes of Phantom’s legitimate interests in investigating and responding to claims and disputes relating to use of Phantom’s services and features, and/or necessary for compliance with applicable legal requirements.

USER RIGHTS & CHOICES

Phantom provides ways for you to access and delete your personal information as well as exercise applicable data rights that give you certain control over your personal information.

All Users

Email Subscriptions. You can always unsubscribe from our commercial or promotional emails by clicking unsubscribe in those messages. We will still send you transactional and relational emails about your use of the Lyft Platform.

Profile Information. You can review and edit certain account information you have chosen to add to your profile by logging in to your account settings and profile.

Location Information. You can prevent your device from sharing location information through your device’s system settings. But if you do, this may impact Phantom’s ability to provide you our full range of features and services. You may also control some elements of sharing your location with Phantom in your Phantom account settings.

Cookie Tracking. You can modify your cookie settings on your browser. You may also further control your cookie setting.

Deleting Your Account.  In some cases, we will be unable to delete your account, such as if there is an issue with your account related to trust, safety, or fraud. When we delete your account, we may retain certain information for legitimate business purposes or to comply with legal or regulatory obligations. For example, we may retain your information to resolve open insurance claims, or we may be obligated to retain your information as part of an open legal claim. When we retain such data, we do so in ways designed to prevent its use for other purposes.
